Smt. Vakkalagadda Santhoshamma v. The Commissioner

THE HON'BLE SRI JUSTICE S.V.BHATT Writ Petition No.20160 of 2012 ORDER :

Heard the learned counsel for petitioners and the learned Assistant Government Pleader.

The operative portion of the communication impugned in the Writ Petition reads as follows :

"In this regard, I submit that as per the Circular No.P & M (1) 3/2006, Dated 22.08.2006 of Commissioner of Horticulture, AP, Hyderabad, the guidelines for selection of beneficiaries and release of assistance under Horticulture schemes, the copy of Pattadar Pass Book or certificate from the Village Secretary is required. The copy of the guidelines is here with submitted for kind perusal. In view of the above, I submit that the Oil Palm Seedlings will be issued to Sri Vakkalagadda Alfred George, S/o Sri Late China Adham, Meerjapuram (V) Nuzvid (M) Krishna District after production of true copies of the Pattadar Pass Book or certificate from the concerned Village Revenue Officer."

The learned counsel for petitioners submits that petitioners are in a position to comply with the objections and having regard to the stand taken by the respondents in the counter-affidavit, the petitioners may be given sometime if the petitioners are still interested in having oil palm seedlings. As the submission of the learned counsel is very limited, I am satisfied the Writ Petition can be disposed of by this order. The

petitioners are given four weeks from the date of receipt of a copy of this order to file representation/compliance to the impugned communication dated 09-02-2012 and on receipt of such representation/reply, the respondent No.2 is directed to pass appropriate orders in accordance with law within a further period of eight weeks from the date of receipt of representation.

The Writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of.
