HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.530 of 2019 ORDER:

The prayer of the petitioner in this case reads as under: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the inaction of the respondents in not receiving and registering the document i.e., sale deed presented by the petitioner in respect of in respect of the petitioner's Plot bearing No.129 in survey No.32 admeasuring 240 Sq Yards situated at Guttala Begumpet Village, Serlingampally Mandal, Ranga Reddy District, as illegal, arbitrary, violation of Articles-14, 21 and 300A of the Constitution of India and in violation of Stamps and Registration Act and consequently, direct the respondents to receive and register the document i.e.

, sale deed presented by the petitioner in respect of his Plot bearing No.129 in Survey No.32 admeasuring 240 Sq Yards situated at Guttala Begumpet Village, Serlingampally Mandal, Ranga Reddy District, in accordance with law and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

Though the learned Assistant Government Pleader for Revenue, State of Telangana, sought time to get instructions in the matter on 21.01.2019, he fairly concedes that he was not able to secure any instructions.

As the grievance of the petitioner is only to the effect that the registration authorities are not receiving the document presented by him for registration, this Court sees no reason to keep the Writ Petition pending for further adjudication.

The Writ Petition is accordingly disposed of directing the SubRegistrar, Ranga Reddy Registration Office, Hyderabad, to receive any document presented by the petitioner in relation to his plot

bearing No.129 in Survey No.32 of Guttala Begumpet Village, Serlingampally Mandal, Ranga Reddy District, and process the same for registration. In the event the said document is found to be in compliance with the requirements of the Registration Act, 1908 (for short 'the Act of 1908') and the Indian Stamp Act, 1899, the SubRegistrar, Ranga Reddy Registration Office, Hyderabad, shall complete the registration formalities and release the document in accordance with the due procedure. However, if for any reason the Sub-Registrar finds any ground to refuse registration of the document presented by the petitioner, he shall pass a refusal order under Section-76 of the Act of 1908 and communicate the same to the petitioner.

Pending Miscellaneous Petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR 04th February, 2019 DR
