THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL APPEAL No.909 OF 2006 JUDGMENT:
This appeal is filed under Section 378 (3)&(1) Cr.P.C. assailing the judgment dated 26.10.2005 in C.C.No.1 of 1999 on the file of the Court of the III Additional District and Sessions Judge-cum-Special Judge for ACB Cases, Visakhapatnam, wherein and whereby the respondent-accused officer was found not guilty for the offences punishable under Sections 7 and 13(1)(d) read with 13(2) of the Prevention of Corruption Act, 1988 and consequently, acquitted him.

At the time of arguments, learned counsel for the respondent submitted that the respondent died during pendency of the appeal. 3.
The learned Special Public Prosecutor-cum-Standing Counsel for A.C.B., also submitted that the respondent died on 27.6.2013 and all the retiral benefits were paid to his legal representatives in view of G.O.Ms.No.2, Labour Employment Training and Factories (VIG) Department, dated 13.1.2015. 4.
In view of the submission made by the learned counsel for both parties, the Criminal Appeal is dismissed as abated. 5.
Consequently, Miscellaneous Petitions, if any, pending in this Criminal Appeal shall stand closed.
