ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/A1 seeking to quash the proceedings in C.C.No.143 of 2014 on the file of Additional Judicial First Class Magistrate, Srikakulam, registered for the offences punishable under Sections 498-A, 323, 342 read with Section 34 IPC and under Sections 3 and 4 of Dowry Prohibition Act, against him.

2. It is alleged in the charge sheet that the marriage of the daughter of the de facto complainant was performed with A1 as per Hindu rites and customs and at the time of marriage he gave an amount of Rs.,5 lakhs and odd and 5 tulas of gold as dowry apart from other articles. It is alleged that since the date of marriage, A1 with the support of his family members, i.e., A2 to A4 harassed his daughter both mentally and physically by demanding additional dowry and they also beat his daughter with hands and dragged her with tuft of hair on the floor of house.

3. Heard and perused the material on record.

4. As per the charge sheet, serious allegations are made against the petitioner/A1. In view of the same and also the nature of proceedings, this Court is not inclined to interfere with the impugned proceedings. However, as the matter arising out of matrimonial dispute, the identity of petitioner/A1 does not arise and

as such, the presence of petitioner/A1 before the trial Court is dispensed with except on the dates whenever his presence is insisted by the trial Court and he shall be represented by his counsel on all hearing dates.

5. With the above directions, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
