Yalla Praveen Kumar v. The State Of A.P Rep By Its P.P
SMT JUSTICE T.RAJANI CRIMINAL PETITON No.122 OF 2018 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A2, in Crime No.266 of 2017 on the file of Nagarampalem Police Station, Guntur District. The offences alleged are under Sections 468, 471 and 420 of IPC. 2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
The counsel for the petitioner submits that the report based on which the crime was registered does not contain the name of this petitioner. The public prosecutor submits that the confession of A1 reveals the role played by this petitioner in collecting money for allotment of flats.
4.
Hence, in view of the above circumstances, this court opines that this is not a fit case for granting anticipatory bail. 5.
Accordingly, the Criminal Petition is dismissed.
However, in the event of any necessity of arrest of the petitioner, the police shall strictly follow Section 41A of Cr.P.C. and the guidelines laid down by the Hon'ble Apex Court in Arnesh Kumar Vs. State of Bihar1.
6.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 23.01.2018 SS 1 2014 (5) SCC 324
