The Petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri Jalli Kanakaiah, , Advocate for the Petitioner and of the Public Prosecutor (TG) for the Respondent, the Court made the following ORDER:
This Criminal Petition is filed by the petitioner/Accused under section 437 and 439 Cr.P.C., seeking grant of bail to the petitioner, who is accused in Crime No. 190 of 2017 of Cherial Police Station, Siddipet district [Medak district], registered for the offences punishable under section 3 [1] [r] [s] of SC/ST [POA] Act, 2015, 3 [i] {v} A CLA Act and section 290, 323 I.P.C.
2. Heard both sides.
3. The counsel for the petitioner submits that the petitioner has been in jail since 11/12/2017. The court below, considering the submission of the Public Prosecutor, that the petitioner slapped the defacto complainant in the full public view and abused him in caste name, dismissed the petition. But however, considering the fact that the petitioner has been in jail since 11/12/2017 and that the material part of the investigation is completed, this Criminal Petition is allowed and the petitioner/accused is directed to be
released on bail on his executing a personal bond for Rs.20,000=00 [Rs. Twenty Thousand only] with two sureties for a like sum each to the satisfaction of Additional Judicial Magistrate of First Class, Jangaon, Jangaon district.
4. As a sequel, miscellaneous petitions if any, pending in this Criminal Petition shall stand closed.
