2011 passed by the Customs, Excise and Service Tax Appellate Tribunal, Bangalore as well as the impugned Miscellaneous Order No. 26853 of 2013 dated 05.08.2013 refusing to rectify the mistake in the Final Order dated 08.03.2011, the present Central Excise Appeal does not survive and the matter is not pressed. Sri Gopalakrishna Gokhaley, learned Standing Counsel for Customs and Central Excise appearing for the respondent has submitted that he has no objection.
