RESPONDENTS ORAL ORDER This Criminal Petition is filed for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.1, 3 and 4 in FIR No.174/2025 before the Kubeer Police Station, Nirmal District.

The brief facts of the case are that on 31.10.2025, at about 10.00 hours, after completion of work, the de facto
complainant/LW1 went to his house around 12.00 hours and noticed the petitioners along with other accused trespassing into his agricultural land and taking measurements of the plot. On observing the same, LW1 recorded a video in his cell phone, upon which A1 approached him, abused him in filthy language, and beat him with a stick, while A3 assaulted him with an iron rod and the other accused also beat him with a stick, causing injuries to his right shoulder, right cheek, and head. It is further alleged that earlier also the accused persons had assaulted LW1 in connection with the plot dispute. 3.
Heard Mr. P.Raju, learned counsel for petitioners, and Mr.
D.Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondents - State. 4.
Learned counsel for petitioners submitted that accused No.2 is already arrested and petitioners who are A1, A3 and A4 are innocent of the alleged offences. While advocating that the petitioners are no way connected to the alleged offence, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor vehemently opposed the submissions made by the learned counsel for the petitioners, stating that petitioner Nos.1 and 2 are involved in couple of other crimes and there are specific set of serious allegations against the petitioners. Therefore, prayed this Court to dismiss the criminal petition.

Having regard to rival submissions made and on going through the material placed on record, it is noted that petitioner No.1 is involved in two other crimes, petitioner No.2 is involved in four other crimes and is a rowdy sheeter. That being so, in view of the settled legal position, this Court is of the opinion that bail cannot be granted to petitioner Nos.1 and 2, and the criminal petition shall stand dismissed against them. However, keeping in mind the fact that there are no specific allegations against petitioner No.3, bail is granted to him subject to the following conditions,.
i.
The petitioner No.3 shall surrender before the Station House Officer, Kubeer Police Station, Nirmal District, within two
weeks from today, and on such surrender, the said Station House Officer shall release them on bail, on him executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner No.3 shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner No.3 shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

Accordingly, this Criminal Petition is partly allowed, granting the relief of anticipatory bail to petitioner No.3. Miscellaneous applications, if any pending, shall stand closed.
