HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.18105 of 2011 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondents in disconnecting power supply to the petitioner's premises without verifying the records, and on the basis of an incorrect bill issued for the month of May, 2011 showing an amount of Rs.14,912/- as arrears, as being illegal and arbitrary. By way of interim relief, a direction was sought to the respondents to forthwith restore power supply to the subject premises. By the order, in WPMP No.21811 of 201, interim direction as sought for was granted on condition that the petitioner deposited Rs.5,000/-. Sri Shaik Jeelani, Learned Counsel for the petitioner, would submit that the said sum of Rs.5,000/- has already been paid. If that be so, the balance amount due, in terms of the earlier notice, is Rs.9,912/-. As the petitioner claims that the bill itself is erroneous, suffice it to permit him to submit a representation in this regard, to the second respondent, within two weeks from today;

and, on such a representation being made, the respondent shall consider the same and pass orders thereupon in accordance with law, within four weeks thereafter. It is open to the respondents thereafter, if need be, to take action against the petitioner in accordance with law. It is made clear that, in case the petitioner does not submit any representation within the time stipulated hereinabove, it is open to the respondents to recover arrears of electricity dues from the petitioner, in accordance with law, within three weeks from the date of receipt of a copy of this order.
