HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.13721 OF 2009 ORDER:
This writ petition is filed seeking Writ of Mandamus directing the respondents to consider the case of the petitioner for awarding promotion to the post of Manager (Technical) in accordance with the A.P.SFTVTDC Regulations, 1988, and also as per the amended Special Promotion Rule which came into force with effect from 06.05.2009 along with other eligible candidates by taking into consideration of his length of service, seniority and merit by duly declaring the action of the 2nd respondent in not communicating the Office Order bearing No.FDC/ESTT/Promo/2009, dated 05.05.2009 issued by the 2nd respondent and not including his name in the list of candidates proposed for placing before the Departmental Promotion Committee, which is scheduled to be held on 15.07.2009 is nothing but arbitrary, discriminatory and violative of Articles 14 and 16 of the Constitution of India.
It is submitted by the learned counsel for the petitioner, that the cause in the present writ petition does not survive for adjudication and the same has become infructuous.
Recording the said submission, the writ petition is dismissed as infructuous. There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall also stand closed. ____________________________ CHALLA KODANDA RAM, J Dated: 04.01.2016 Ssv
