THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE DR JUSTICE SHAMEEM AKTHER Writ Appeal No.297 of 2017 JUDGMENT: {Per the Hon'ble the Acting Chief Justice Ramesh Ranganathan} Neither is Sri Mohd. Rafeeuddin Ahmed, learned counsel for the respondent-writ petitioner, present nor is there any representation on his behalf.
Both Sri V.Sreenivasa Rao, learned counsel for the appellant-4th respondent, and Sri P.Kesava Rao, learned Standing Counsel for the GHMC, would submit that a vacate stay petition was filed, and the writ petition was directed to be posted for final hearing in the usual course. The Learned Single Judge has neither examined the vacate stay petition on its merits nor are any reasons assigned, in the order under appeal, for posting the matter for final hearing in the usual course. The order under appeal is set aside. The writ petition shall stand admitted, and the vacate stay petition shall be listed before the appropriate bench.
The Writ Appeal is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
