THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CONTEMPT CASE No. 33 of 2020 ORDER:
This Contempt Case is filed alleging non-compliance of order dated 02.12.2019 passed by this Court in Writ Petition No.26563 of 2019.
By aforesaid order, this Court allowed the Writ Petition by setting aside the judgment impugned therein. In the said order, this Court made certain observations, which read as under: "As both the learned counsel are ready to proceed with the matter, particularly, in view of the assertion of the learned counsel for the petitioners that he would not seek any adjournment and he would appear before the Tribunal on the day fixed by this Court and also considering the fact that the Chairman will conduct the proceedings only on Fridays, with the consent of learned counsel for both the parties, the date for hearing of the appeal is fixed as 13.12.2019 by making it clear that under no circumstances, the Tribunal shall grant adjournments to either of the parties and complete the hearing of the Appeal and pass orders on merits."
It is the complaint of the petitioners that though the Tribunal had restored, heard and reserved the appeal for orders, the respondent had not restored their positions as Managing Committee Members of Muthyal Rao Cooperative Housing
CKR, J C.C.No.33 of 2020 Society Limited, in terms of the order dated 19.03.2018 passed by this Court in Writ Petition No. 13651 of 2017. There is no dispute that the appeal was restored to file, the parties were heard and the orders were reserved on 13.12.2019. In those circumstances, this Court does not find any violation on the part of the respondent in complying with the order dated 02.12.2019 passed by this Court in Writ Petition No.26563 of 2019.
