ORDER

This petition is filed under Section 482 Cr.P.C., to quash the proceedings in Crime No.79 of 2017 of Anantapuramu III Town Police Station, Ananthapuramu District, registered for the offences punishable under Sections 498-A, 307, 506 read with Section 34 IPC and under Sections 3 and 4 of Dowry Prohibition Act and under Section 66(E) of I.T.Act, 2000, against the petitioner/A4, on various grounds.

Learned counsel for petitioner, after arguing the matter for sometime, requested this Court to direct the police concerned to follow the procedure under Section 41-A Cr.P.C. 3.

As the act allegedly done by the petitioner/A4 would attract the offence punishable under Section 354-D(ii) of IPC and no allegation is made against him to constitute the offence punishable under Section 307 of IPC, the Investigating Officer is directed to follow the procedure under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar1. 4.

With the above direction, the Criminal Petition is disposed of. 5.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
