HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9515 OF 2017 ORDER:
This Criminal Petition is filed under Section 482 Cr.P.C by the petitioner/ A3, seeking to quash the proceedings in Crime No.311 of 2016 on the file of Chaderghat Police Station, Hyderabad, registered for the offences punishable under Sections 406 and 420 r/ w 34 I.P.C. and subsequently by filing memo added the offences punishable under Sections 468 and 471 r/ w 34 I.P.C.
Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the State before ordering notice to respondent No.2/ de facto complainant and perused the grounds urged in the Criminal Petition, the contents of F.I.R., altered memo and other material on record.
In fact, the crime is pending for investigation for the past more than one year from 04.09.2016. Hence, there is nothing to admit the Criminal Petition, much less, to interdict the investigation, but for, to direct the Police to complete the investigation and file final report, within a period of two months from the date of receipt of copy of this order and in the event of any necessity of arrest of the petitioner/ A3 is required, the Police strictly follow Section 41-A Cr.P.C. and the guidelines of the Apex Court as laid down in Arnesh Kumar v. State of Bihar1.
