HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.348 of 2019 ORDER:

The prayer of the petitioner in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of Respondent No.3 in not passing Orders on the conversion of the land admeasuring total extent of Acs.5-00 guntas, i.e., Ac.0-13 guntas in Survey No.297/2, Acs.2-00 guntas in Sy.No.297/8/AA, Ac.1.13 guntas and Ac.1.14 guntas in 297/11/E of Kollur Village, Ramchandrapuram Mandal, Sanga Reddy District, Telangana State, under Telangana Agricultural Land (Conversion for Non Agricultural purposes) Act, 2006, as arbitrary, illegal, colourable exercise and misuse of power contemplated under law and consequently direct the 3rd Respondent to pass and issue the Conversion Proceedings in respect of the aforesaid land and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

The matter was adjourned on 04.01.2019 to enable the learned Assistant Government Pleader for Revenue, State of Telangana, to get instructions or file a counter. However, he would inform this Court that no instructions have been furnished to him as on date.

Perusal of the record reflects that the petitioner made an application to the Revenue Divisional officer, Sanga Reddy District, in Annexure-A under Rule 3(1) of the Rules framed under the Telangana Agricultural Land (Conversion for Non Agricultural Purposes) Act, 2006, as long back as on 12.7.2017. It is not open to

SK, J WP.No.348 of 2019 Dt:28.02.2019 the competent authority to receive such an application and remain unmoved.

The Writ Petition is accordingly disposed of directing the Revenue Divisional Officer, Sanga Reddy District, to take appropriate action upon the petitioner's application dated 12.7.2017 in accordance with the due procedure expeditiously and in any event, not later than eight weeks from the date of receipt of a copy of this order, be it from whatever source.
