HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.21482 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of shop No.24, Annavarappadu Village, Peravali Mandal, West Godavari District. When the fourth respondent passed orders on 11.11.2014 entrusting distribution of essential commodities to a local Primary Agricultural Cooperative Society, without pendency of any disciplinary proceedings, the petitioner filed W.P.No.35301 of 2014. This Court, by order dated 25.11.2014, allowed the Writ Petition. Thereafter, the third respondent passed an order, on 12.03.2015, suspending the authorization of the petitioner. Challenging the said order of suspension, the petitioner approached this Court in W.P.No.

8195 of 2015 which was disposed of, by order dated 26.02.2015, directing the third respondent to complete enquiry, and pass final orders, within a period of eight weeks. The third respondent, without completing enquiry, passed the impugned order confirming the order of suspension dated 12.03.2015. Hence the Writ Petition. A perusal of the order, in the instant case, shows that there is no need for the third respondent to pass the impugned order dated 17.06.2015, confirming the order of suspension dated 12.03.2015. The third respondent ought to have followed the order of this Court, in W.P.No.8195 of 2015 dated 26.02.2015, and should have passed a final order after completing the enquiry. Instead of that, he passed the present ratification order which is unnecessary.

W.P.No.8195 of 2015 dated 26.02.2015, the third respondent is directed to complete enquiry, and pass final orders, in respect of the petitioner, who was a dealer of shop No.24, Annavarappadu Village, Peravali Mandal, West Godavari District, within a period of thirty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs. _______________________________ A.
