Anji Reddy 70 Mm v. Government Of Andhra Pradesh,
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26971 of 2009 ORDER:
It is represented by the learned counsel for petitioner that the facts in the instant case are similar to the facts in W.P.No.27273 of 2009 dated 28.09.2015.
2.
In view of the same, this writ petition is also disposed of with the following directions.
" As the petitioner-theatre claims to have rectified all the defects pointed out earlier in relation to fire safety measures and as the authorities concerned also confirmed this aspect, the writ petition is allowed, setting aside the impugned proceedings No.H7/7691/2009, dated 30.11.2009, issued by the Joint Collector and Licensing Authority, Nalgonda. However, this order shall not preclude the respondent authorities from causing inspection of the petitioner-theatre as and when necessary to verify as to whether sufficient fire safety measures have been put in place and in the event of deficiency is noticed in this regard, the petitioner-theatre shall be asked to make good the same in accordance with law."
3. The writ petition is, accordingly, allowed. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed. _______________________________ A.RAMALINGESWARA RAO, J Date: 28.03.2016.
