THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38490 of 2016 ORDER:
This writ petition is filed seeking to declare the action of the 4th respondent in interfering with personal liberty of the petitioners with active support of respondents 5 to 8 even without registering FIR and calling to the police station by threatening the petitioners to hand over the house bearing No.3-61, situated at Kommai Cheruve, H/o. Cheyyeru Village, Katrenikona Mandal, East Godavari District, to the 5thr respondent, as illegal and arbitrary.
Heard and perused the material available on record. The main grievance of the petitioners is that the marriage between the 1st petitioner with the 5th respondent was performed in the year 2009. The 5th respondent, with the help of respondents 6 to 8 has lodged a complaint to the 4th respondent and basing on the said complaint, the 4th respondent is calling the petitioners to the police station and kept the petitioners in the police station for hours together from morning to evening and forcing the petitioners to settle the dispute with the 5th respondent.
Considering the grievance of the petitioners, the 4th respondent is directed not to harass the petitioners without registering any case against the petitioners for cognizable offence. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO, J Date: 9th November, 2016 KL
