HONOURABLE SRI JUSTICE P. KESHAVA RAO I.A. No. 1 of 2020 AND CRIMINAL REVISION CASE No.1930 of 2014 COMMON ORDER:

I.A.No.1 of 2020 is filed to record the compromise and acquit the petitioner/accused in the criminal revision case. Along with the application, a joint memo dated 10.01.2020 signed by both the parties and their respective counsel has been filed.

From a perusal of the affidavit filed in support of the application and the joint memo filed by the parties, it is revealed that during the pendency of the present revision case the petitioner/accused and the 2nd respondent/complainant at the intervention of the elders and well-wishers settled the dispute between them amicably. During the course of negotiations, as per the decision of the elders, the petitioner/accused paid a sum of Rs.3 lakhs to the 2nd respondent towards full and final settlement and the 2nd respondent received and acknowledged the same. Both the parties are present in the Court and they are identified by their respective counsel. The 2nd respondent produced the Xerox copy of his Aadhaar card and the same is made as part of the record.

On interaction with the 2nd respondent/complainant, he accepted that he received Rs.3 lakhs from the

petitioner/accused towards full and final settlement of the dispute arising out of C.C.No.165 of 2011.

In view of the compromise entered into between the petitioner and the 2nd respondent, I.A.No.1 of 2020 is ordered. In view of the orders passed in I.A.No.1 of 2020, the criminal revision case is allowed, setting aside the judgment in Crl.A.No.140 of 2013 dated 12.09.2014 on the file of the Special Sessions Judge for SC/ST (POA) Cases-cum-VII Additional District and Sessions Judge, Warangal, confirming the judgment in C.C.No.165 of 2011 dated 29.11.2013 on the file of the VI Additional Judicial First Class Magistrate, Warangal and the accused is acquitted of the offence punishable under Section 138 of the Negotiable Instruments Act, 1881. As per the terms of the memorandum of compromise, the amount of Rs.1,50,000/- deposited before the Court below in compliance with the orders passed by this Court, the petitioner/accused is entitled to receive the same.
