2019-01-04Sanjay Kumar1 pages

THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.241 of 2019 ORDER:

The prayer of the petitioner in this case relates to the alleged irregularities in the electoral roll drawn up for the Chowdaryguda Gram Panchayat, Ghatkesar Mandal, Medchal-Malkajgiri District. It is however admitted by Sri S.Surender Reddy, learned counsel for the petitioner, that the irregularities which the petitioner alleges in the Gram Panchayat electoral roll are still persisting in the electoral roll drawn up for Chowdaryguda Village for the Legislative Assembly Constituency. Rule 6 of the Telangana Panchayat Raj (Preparation and Publication Of Electoral Rolls) Rules, 2018 (for brevity, 'the Rules of 2018'), prescribes that any objection to an entry in the electoral roll can be settled only after suitable amendment is made to the relevant entry in the electoral roll of the Legislative Assembly Constituency based on which the Gram Panchayat roll was prepared.

The writ petition is accordingly disposed of leaving it open to the petitioner to take steps as per Rule 6 of the Rules of 2018 to raise his objections as to the entries in the electoral roll for Chowdaryguda Village vis-a-vis the Legislative Assembly Constituency in the first instance. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. ____________________ JUSTICE SANJAY KUMAR Date:04.01.2019 PGS
