THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 167 of 2024 ORDER:
This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner/Accused No.1 seeking bail in the event of his arrest in connection with Crime No.51 of 2023 of Women Police Station, East Zone, Hyderabad, registered for the offences punishable under Sections 498-A, 420, 495 of Indian Penal Code (for short 'IPC') and Section 3(1), 4, 6 of Dowry Prohibition Act, 1961 (for short 'D.P Act').

Heard learned counsel for the petitioner and learned Public Prosecutor for the respondent-State and perused the record.

The case of the de-facto complainant/wife of this petitioner is that she was married to petitioner on 08.06.2023. At the time of marriage, cash and other gifts were given on demand. Thereafter, she joined the petitioner herein at his house. The petitioner and other
maternal aunts and brother, treated the de-facto complainant as a maid servant and also abused her in filthy language. The mother of the de-facto complainant tried to settle their issue. However, the harassment continued, for which reason, a complaint was filed. 4.
The main allegation appears to be that this petitioner was earlier married and the said fact was concealed at the time of marriage. Since, the allegations in the complaint are on account of the differences between this petitioner and his wife, this Court, deems it appropriate to grant relief of anticipatory bail subject to the following conditions:-
1) The petitioner/Accused No.1 is directed to surrender before the Station House Officer, Women Police Station, East Zone, Hyderabad on 17.01.2024. Upon such surrender, the said Station House Officer shall release the petitioner/Accused No.1 on bail, on his executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand
only) with two sureties for a like sum each to his satisfaction.
2) On such release, the petitioner/Accused No.1 shall appear before the concerned police at 10.00 AM on everyday for a period of two weeks and thereafter, as and when required for the purpose of investigation.
3) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case. 5.
Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
