Petitioner claims that 3rd respondent is being illegally promoted to the cadre of Personal Officer in the ensuring Department of Promotion Committee. W.P.No.24413 of 2010 is pending on a challenge made to his earlier promotion as Junior Personal Officer, on the ground that he did not have requisite qualified service for such promotion. It is therefore contended that when the issue of his promotion as Junior Personal Officer is pending consideration in W.P.No.24413 of 2010, the question of further consideration for promotion does not arise. 3.

Admittedly, so far no promotion is made to the 3rd respondent. It is not known whether the DPC has ultimately recommended his case for promotion. Petitioner may have grievance only if the 3rd respondent is promoted, and if such promotion is illegal. This Court is not inclined to entertain the writ petition even before a decision is taken and exercise the power of judicial review at this stage. The writ petition is liable to be dismissed.

Having regard to the above, the Writ Petition is dismissed as pre-mature. It is always open to the petitioner to work out her remedies as and when the cause of action arises. There shall be no order as to costs.

Miscellaneous petitions, pending if any, in this writ petition shall stand closed.
