THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.359 of 2020 O R D E R:

This writ petition is filed to declare the action of the 3rd and 4th respondents in interfering with the petitioners' personal liberty and life by calling them to the police station to pay the amounts illegally demanded by the 6th respondent threatening to involve in false cases, as being illegal and arbitrary.

Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 08.01.2020, submits that, based on the complaint made by the 6th respondent in the writ petition, a case was registered against the petitioners in Crime No.912 of 2019 for the offences punishable under Sections 417 and 420 IPC on the file of Jawaharnagar Police Station, on 14.12.2019, wherein the petitioners herein are arrayed as accused Nos.1 to 3. It is further submitted by the learned Assistant Government Pleader that, except conducting investigation in the above said case, the respondent police never interfered in the civil disputes of the petitioners at any point of time and the petitioners, having come to know about the complaint made by the 6th respondent against the petitioners, had come up with the present writ petition to bring pressure on the police officials and to divert them from investigating the case. 4.

Having regard to the fact that a case in Crime No.912 of 2019 has already been registered and is pending investigation, the claim of the petitioners that the 3rd respondent is interfering in the personal life and

liberty of the petitioners by calling them to the police station without there being any case, does not appear to be correct. However, since a case is registered against the petitioners and is under investigation, the 3rd respondent shall investigate into the above crime in accordance with law. 5.

Subject to the above observation, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
