HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 5233 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the proceedings dated 14.05.1998 and also the proceedings of the appellate authority dated 03.07.2002 as illegal and arbitrary. A consequential direction is also sought to the respondents to reinstate the petitioner into service with continuity of service, back wages and attendant benefits.

When the matter is taken up for hearing, learned counsel for the petitioner submits that during pendency of the writ petition, the petitioner has attained the age of superannuation. Having considered the said submission, this Court is of the considered view that the relief sought by the petitioner to reinstate him into service may not be feasible at this point of time. However, the writ petition can be disposed of directing the respondent corporation to pay the service benefits of the petitioner for the service rendered by him prior to his removal from service, if not already paid, in accordance with the Regulations, within a period of four (4) weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
