HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3699 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/ accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.66 of 2015 of Kadapa I Town Police Station, Kadapa registered for the offences punishable under Section 420 IPC.

2) Heard learned counsel for the petitioner/ accused as well as the 1st respondent representing through public prosecutor before admission and before ordering any notice to the 2nd respondent-de facto complainant.

3) A perusal of the report shows there are no grounds to quash the FIR at this stage. However, while the investigation shall be allowed to go on, as the facts admit concession of bail and the petitioner being a public servant even from the report, by giving liberty to petitioner to surrender before the Learned Magistrate concerned and move for regular bail with notice to learned Assistant Public Prosecutor concerned and in such an event, the learned Judge/Magistrate shall consider for granting of bail in his favour with necessary conditions preferably on the same day. Needless to say pending investigation while granting bail the learned Magistrate can dispense with his appearance before the Court. Any remedy is left open to the petitioner after final report filed by the police under Section 173 Cr.P.C.

4) With the directions supra, the Criminal Petition is disposed of.

5) Miscellaneous petitions, if any pending, shall stand closed. _________________________
