K.M. Baswaraj v. The Regional Manager
THE HON'BLE SRI JUSTICE M.S.K. JAISWAL.
W.P.No.15435 of 2004 Oral Order:
This writ petition is filed by the petitioner seeking regularization of his services with effect from 1.8.1992 instead of 29.9.1994 on the ground that by 1.8.1992 he completed 240 days of service having been regularly appointed vide the proceedings dated 8.8.1991. The main contention of the learned counsel for the petitioner is that the petitioner along with several others were appointed as driver in the respondent-Corporation and that the petitioner was shown at serial no.16, joined the duty on 8.8.1991 and by 28.6.1992 he completed 240 days of service, therefore his services ought to have been regularized with effect from 1.8.1992.
Along with the writ petition, the petitioner also filed WPMP No.20031 of 2004 and this Court by its interim order dated 1.10.2004 directed the respondentCorporation to consider the case of the petitioner for regularization of his services on par with T.Sharanaiah and pass appropriate orders. In pursuance of the said interim orders of this Court, the respondent-Corporation has
regularized the services of the petitioner as sought for. Sofar as the case of T.Sharanaiah is concerned, this Court in W.P.No.18681 of 1998 by its order dated 18.8.1998 directed to regularize his services with effect from the date on which he completed 240 days of service but not subsequent thereto.
In view of the interim orders of this Court dated 1.10.2004 in WPMP No.20031 of 2004, and it being complied with, nothing survives for further adjudication in the matter. Hence, the writ petition is accordingly disposed of in terms of interim order dated 1.10.2004 in WPMP No.20031 of 2004. No costs. Miscellaneous Petitions if any shall stand closed.
