HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.393 OF 2018 O R D E R :

This petition is filed challenging the impugned notice in Letter No.ADE/OP/IBRAHIMBAGH/D.No.856, dated 09.10.2017, whereby the petitioner was asked to pay 50% of the assessed amount i.e.60,874/- and other charges to obtain reconnection and the remaining 50% in two instalments.

Heard learned counsel for the petitioner and Sri R.Vinod Reddy, learned Standing Counsel for respondents. Though learned counsel for the petitioner disputes that the petitioner has not used power unauthorisedly, it is a matter for enquiry under Section 126(4) of the Electricity Act. Pending such determination there shall be stay of disconnection on payment of 50% of the demanded amount i.e.Rs.60,874/- by the petitioner, within a period of four weeks from today. However, the said payment shall be subject to final determination under Section 126(4) of the Electricity Act.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
