HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No. 1406 of 2005 ORDER:

Heard the learned counsel for the petitioner. During the course of hearing, it is brought to the notice of this Court that the petitioner in the present criminal revision case died on 13.10.2016. To that effect, a xerox copy of the death certificate issued by the competent authority i.e. the Registrar of Births and Deaths is placed before this Court and the same is placed on record. In the present criminal revision case, the petitioner is convicted for an offence under Section 138 of the Negotiable Instruments Act and he is sentenced to undergo simple imprisonment for a period of six months and pay a fine of Rs.5,000/ -. As far as Rs.5,000/ - fine amount is concerned, it was already paid during the pendency of the appeal before the lower appellate Court. As far as the sentence of imprisonment is concerned, it is abated by virtue of death of the petitioner.

Accordingly, the criminal revision case is dismissed as abated. Miscellaneous petitions, if any, pending in this criminal revision case shall stand dismissed.
