THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.3608 OF 2017 ORDER:

This petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioner/A.4 in S.C.No.165 of 2017 on the file of the Court of the XV Additional District Judge, Miyapur, Ciberabad.

Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor.

The only relief sought by the learned counsel for the petitioner is that the presence of the petitioner/A.4, who is having a small kid, before the trial Court may be dispensed with on each and every date of adjournment. In view of the submission made by the learned counsel for the petitioner, this Court is not inclined to go into the merits of the main case. A perusal of the record reveals that the petitioner is staying at Pune in Maharashtra District.

There is no dispute with the regard to the identity of the petitioner, who is accused No.4 in the case and even if her presence is dispensed with, no prejudice will be caused to the 2nd respondent.

In view of the submission made by the learned counsel for the petitioner, the presence of the petitioner, who is accused No.4 in S.C.No.165 of 2017 on the file of the Court of

the XV Additional District Judge, Miyapur, Ciberabad is dispensed with on each and every date of adjournment. However, the petitioner shall appear before the trial Court as and when her presence is so required.

With the above observations, this Criminal Petition is disposed of. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed. __________________________ T. SUNIL CHOWDARY, J.
