THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8197 of 2009 ORDER:
This Writ Petition is filed seeking to direct the respondent to dispose of the representations of the petitioner dated 19.09.1996, 21.07.2006, 29.10.2007 and 12.11.2008 for recognizing him as Mahant of Galigopuram Mutt, Tirupati, Chittoor District.
On 01.08.2018, when the matter was taken up for hearing, learned Government Pleader for Endowments appearing for the respondent placed on record a memo, dated 19.04.2017 and submitted that the petitioner had in fact filed Writ Petition No.35638 of 2016 seeking to direct the respondents therein to consider his representation dated 07.10.2016 and this Court disposed of the said Writ Petition vide order, dated 21.10.2016 directing the respondents therein to consider such representation and take appropriate action in accordance with law and in pursuance of the said order, by the aforesaid memo, fresh representation filed by the petitioner on 07.10.2016 came to be disposed of on 19.04.2017.
CKR, J WP.No.8197 of 2009 It may be noted that the relief sought by the petitioner in the instant Writ Petition as well as Writ Petition No.35638 of 2016 is identical. It may also be noted that inasmuch as the representation of the petitioner dated 07.10.2016 stands disposed of by the aforesaid memo, dated 19.04.2017 rejecting his claim to be recognized as a Mahant, so far as the relief claimed by the petitioner in the present Writ Petition is concerned has become infructuous.
Today, learned counsel for the petitioner submits that as against the aforesaid memo, the petitioner had filed a revision before the Government on 05.07.2017 and the same is pending and thereby, prays for issuance of a direction to the Government to dispose of such revision in a time-bound manner. In those circumstances, this Writ Petition is dismissed, giving liberty to the petitioner to pursue the revision before the Government.
Miscellaneous Petitions, if any pending, shall stand dismissed. There shall be no order as to costs. _________________________ CHALLA KODANDA RAM, J 8th AUGUST, 2018.
