HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CIVIIL REVISION PETITION No.1399 of 2017 ORDER:
This revision petition is filed against the order dated 19-12-2016 in I.A.No.686 of 2016 in O.S.No.200 of 2016, whereby the Court below allowed the application of the 1st respondent/plaintiff under Order 1 Rule 10 (2) and 4 read with Section 151 C.P.C. impleading the defendant No.2 in the suit.
The allegation of the 1st respondent/plaintiff is proposed defendant No.2 is interfering with his possession after filing of suit, as such he filed implead petition for impleading him and the same was allowed. The impleadment is ordered by the Court below as no written statement was filed and trial has not commenced. The Court below also observed no prejudice will be caused if impleadment is ordered. The learned counsel for petitioner also could not state what the prejudice cause to the petitioner is, if impleadment of defendant No.2 is ordered. Even then, if the petitioner has any objections, he shall raise all his objections at the stage of trial before the Court below.
In view of the above facts and circumstances, there are no grounds to interfere with the impugned order and accordingly, the revision petition is liable to be dismissed.
Accordingly, the revision petition is dismissed. As a sequel to the disposal of this revision, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 14-07-2017 Nvl
