HON'BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION No.4662 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the learned Government Pleader for Civil Supplies appearing for the respondents.

2. This writ petition is filed seeking to declare the action of the respondents in seizing the lorry bearing No.AP 02 U 6299 and the order passed by the 2nd respondent in proceedings Rc.No.K9/PKD/45/2015 dated 28.01.2015 directing the petitioner to furnish Bank Guarantee for Rs.1,57,500/- as security for release of seized vehicle, as arbitrary and illegal.

3. According to the petitioner, he is the owner of the lorry bearing No.AP 02 U 6299. On 16.01.2015, the said lorry was intercepted by the Penukonda Police on the ground of illegal transportation of rice. The petitioner made an application before the 2nd respondent for release of the lorry pending 6-A proceedings. The 2nd respondent passed an order dated 28.01.2015 ordering release of the lorry on furnishing of bank guarantee for Rs.1,57,500/- by the petitioner. This Court is of the view that the condition is not onerous. Therefore, the order cannot be interfered with.
