Proof of service filed. There is no representation for the 2nd respondent. Heard the further arguments in continuation of the interim order of this Court from the hearing on 28.08.2017, also heard the learned Public Prosecutor representing the 1st respondent-State and taken as heard the 2nd respondent and perused the material on record.

The Criminal Petition is disposed of making absolute the interim order of stay of arrest pending investigation but investigation shall go on however it will not prevent the police to secure presence of the petitioner for the purpose of investigation if necessary.

Consequently, miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
