THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34413 of 2015 ORDER:
The petitioner is a fair price shop dealer of Palyam Thanda, Pamidi Mandal in Anantapur District. The authorisation of the petitioner was cancelled on 24.03.2015 by the third respondent after issuing the show cause notice and against the said order, the petitioner preferred an appeal to the second respondent along with a stay application. The stay application was dismissed by order dated 28.07.2015 and the record was called for from the third respondent for consideration of the appeal. Even after two months when no orders were passed by the second respondent, the present Writ Petition is filed.
In view of the pendency of the appeal before the second respondent, this Court is not inclined to go into the merits of the case. However, the second respondent is directed to conduct the enquiry and pass final orders in the appeal preferred by the petitioner against the order of the third respondent dated 24.03.2015, within a period of sixty days from the date of receipt of a copy of this order. The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed.
