Heard learned Counsel for the petitioner/accused No.5, and the learned Public Prosecutor before admission and before notice and perused the material placed on record.

There is no need either to admit or to keep the matter pending by ordering notice to respondents 2 and 3 much less to stay proceedings but for disposal. Accordingly, this Criminal Petition is disposed of by suspending execution of nonbailable warrant stated pending against the petitioner/A.5 for one month so that he can come down to India and appear before the Court concerned and move for bail with assurance for future appearance.
