THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.33563 of 2014 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.

The petitioner was appointed as a Fair Price Shop dealer of Shop No.32 of Alur Village and Mandal in Kurnool District on regular basis vide proceedings dated 28.06.2008. When the authorization of the petitioner expired, the petitioner applied for renewal on 17.06.2014 within time duly paying the amount. The stock was released till September, 2014. When the respondents were not releasing the stock thereafter, the present Writ Petition was filed on 05.11.2014 seeking a direction to release the stocks.

Learned Government Pleader, on the basis of instructions, submits that the petitioner applied for four months leave without producing the medical certificate, and after expiry of four months, she did not produce the fitness certificate. However, it is not in dispute that the authorisation of the petitioner is subsisting. If the authorisation of the petitioner is subsisting, the petitioner is entitled to the supply of essential commodities in accordance with the rules. In the circumstances, the Writ Petition is disposed of directing respondent Nos.3 and 4 to supply the essential commodities to the petitioner till the authorisation of the petitioner is in subsistence. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 04.06.2015
