THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 22152 OF 2004 ORDER:

When the matter is taken up for hearing, none appeared for the petitioner in spite of the fact that the writ petition is listed under the caption of dismissal.

A perusal of the record disclosed that the petitioner is seeking absorption into aided service. It has been stated by the petitioner that he was appointed as Record Assistant in respondent No. 5-school in an unaided vacancy vide proceedings dated 09-11-2002 and ever since then, he has been discharging his duties. The petitioner sent a representation to the respondents to absorb him into aided service but the respondents have not absorbed him in aided service. In those set of circumstances, the petitioner filed the present writ petition seeking absorption into aided service. The petitioner further contended that in similar circumstances, the respondents have ratified the appointments of certain persons working in unaided posts in terms of G.O.Ms.No. 524 dated 20-11-1988 and contended that the petitioner also be absorbed into aided service.

This Court having considered the above said facts is of the considered view that the writ petition can be disposed of directing respondent Nos. 5 to submit fresh proposals if the petitioner is discharging his duties as Record Assistant as on today to respondent Nos. 1 to 4 within two weeks from the date of receipt of a copy of this order and upon such proposals being received from respondent No. 5, respondent Nos. 1 to 4 shall consider the same

and pass appropriate orders in accordance with law in another four weeks thereafter.

With these observations, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in consequence. No costs.
