HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.25026 OF 2007 ORDER:
Challenging the Notification issued under Section 4(1) of the Land Acquisition Act, dated 13.05.2006, this Writ Petition is filed. Pursuant to the Notice issued by this Court, the respondents filed Counter affidavit, for which the petitioners filed a reply affidavit. Upon considering the same, this Court admitted the Writ Petition on 22.01.2008. Thereafter, on 24.03.2017, this matter was referred to Lok Adalat, however, since there was no settlement arrived at, it was listed before this Court on 23.05.2018. In spite of several adjournments, there was no representation on behalf of the petitioners. On 25.10.2018, learned counsel for the petitioners submitted that out of four petitioners, two petitioners died and requested time for bringing their legal representatives on record. The matter was, therefore, adjourned by a week. On 01.11.
2018 also there was no representation for the petitioners, hence, it was posted to 08.11.2018 under the caption 'for dismissal'. When the matter is taken up today, there is no representation on behalf of the petitioners, and no L.R. petition is filed. It seems, the petitioners have no interest in prosecuting the Writ Petition.
In those circumstances, the Writ Petition is dismissed for non-prosecution. There shall be no order as to costs. ____________________________ CHALLA KODANDA RAM, J Dated:08.11.2018.
