- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.343 OF 2020 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue for respondents 1 to 4 and learned Standing counsel for respondent No.5. 2.

Petitioner claims that land to an extent of Ac.5-00 in Sy.No.211/2, Sirigaripalli Village, Gajwel Mandal, Siddipet District, belongs to her and she is in possession and enjoyment of the said land and it is a private patta land. While so, petitioner now alleges that the said extent of land is now sought to be utilized for establishing dumping yard. Petitioner alleges that as the said property is a private land which is in her possession, it cannot be utilized for any public purpose, without following the due process and without paying the compensation.

Alleging that the respondents are trying to dispossess the petitioner for construction of dumping yard, inspite of the objections filed by him, this writ petition is filed.

3.

When the matter is taken up, learned Special Government Pleader representing the learned Advocate General, produced copy of the instructions dated 06.01.2020, furnished by Tahsildar, Gazwel. According to these instructions, the proposed dumping yard is in Sy.No.211/11 and not in Sy.No.211/2, as contended by the petitioner.

4.

In view of these instructions, the specific stand of Government that dumping yard is not proposed in Sy.No.211/2, the grievance agitated by the petitioner does not survive for consideration of this Court.

Accordingly, the Writ Petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 8th January, 2020 Rds
