THE HON'BLE SRI JUSTICE A.SHANKAR NARAYANA TRANSFER CRIMINAL PETITION No.71 of 2017 ORDER:

The present petition, under Section 407 of the Code of Criminal Procedure, 1973 is filed to withdraw C.C.No.91 of 2016 pending on the file of the I-Additional Chief Metropolitan Magistrate, Hyderabad, and transfer the same to the file of the Judicial Magistrate of First Class, Tadipatri, Anantapur District.

Heard Ms. A.Vijaya Lakshmi, learned counsel for the petitioner, and the learned Additional Public Prosecutor for the State of Telangana on behalf of respondent No.1.

Learned counsel for the petitioner would submit that the entire transaction has taken place at Tadipatri and the other ground mentioned in paragraph '7' of the affidavit filed in support of the petition is that the petitioner has to travel 400 kms from Tadipatri to Hyderabad and he is suffering from serious ailment. Neither the details of the ailment nor any medical proof in that regard is filed by the petitioner. So far as the submission that the entire transaction has taken place at Tadipatri is concerned, no material in support of the same has been filed and also no details of the transaction, have been furnished in the petition. Even otherwise, in the cause title of the petition, the description of respondent No.2 is shown as the Hyderabad Agricultural Co-operative Association

Limited, which is a registered Association, having its office in Hyderabad. Hence, there is no merit in the present petition. Accordingly, the Transfer Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this petition shall stand closed.
