THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.13769 OF 2017 ORDER:

This writ petition is filed seeking to issue a writ of mandamus to direct the 3rd respondent to cancel the assessment and mutation numbers which were allotted illegally in the petitioner's land situated in Sy.Nos.129/ 1 and 129/ 2 at Chilukuri Laxmi Nagar, Adilabad. Heard and perused the material available on record. It is the case of the petitioner that he purchased an extent of Acs.0.15 gutnas of land in Sy.Nos.129/ 1 and 129/ 2 at Chilukuri Laxmi Nagar, Adilabad, through registered sale deed, dated 09.05.2006. He donated 0.3 guants of land out of 0.15 guntas to an Urdhu School. The remaining land was occupied by land grabbers and the said land grabbers are constructing a house illegally by occupying the 0.3 guntas also which was donated to the School. Therefore, the petitioner filed an application on 13.07.

2016 under Right to Information Act seeking information about the assessment and mutation in respect of the said land. The authority concerned has given a reply stating that 31 assessment numbers and 29 mutations issued in the year 2014 to 2016 in respect of the said land. Therefore, the petitioner submitted a representation to the 3rd respondent on 30.01.2017 requesting to cancel the assessment numbers, which were allotted illegally in respect of his land. But, the 3rd respondent has not taken any action so far. Hence, this writ petition.

Learned counsel for the petitioner mainly contended that though the petitioner submitted as many as four representations, the authority concerned has not taken any action so far and that the respondents may

be directed to consider the representations of the petitioner and pass appropriate orders within a specific period of time. Learned Standing Counsel for the respondents 2 and 3 submitted that the respondents will consider the representations of the petitioner. Considering the submissions of the learned counsel for both sides, without expressing any opinion on merits, this Court is of the view that the writ petition can be disposed of with a direction to the respondents to pass appropriate orders on the representation made by the petitioner within a specific period of time.

Accordingly, the Writ Petition is disposed of directing the 3rd respondent to consider the representation, dated 03.01.2017 made by the petitioner, and pass appropriate orders within a period of eight

(8) weeks from the date of receipt of a copy of this order. No order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
