HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.577 of 2018 ORDER:
The prayer of the petitioners in this case reads as under: For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of respondent No.3 in not disposing of the petitioners' representations dated 17.3.2018, 20.8.2018 and 24.9.2018 made for correction of the land in Sy.No.197/A to an extent of Ac.1.20 guntas of Ragampet Village, Choppadandi Mandal, Karimnagar District, in the pattadar pass books and title deeds as illegal, arbitrary, contrary to the provisions of the Telangana Rights in Land and Pattadar Pass Books Act, 1971, and consequently, direct respondent No.3 to dispose of the petitioners' representations dated 17.3.2018, 20.8.2018 and 24.9.
2018 made for correction of extent of land in Sy.No.197/A to an extent of Ac.1.20 guntas of Ragampet Village, Choppadandi Mandal, Karimnagar District, in the pattadar pass books and title deeds and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case." By way of their representations submitted to the Tahsildar, Choppadandi Mandal, Karimnagar District, the petitioners seek corrections to be made in relation to the extent of the land in the revenue records and consequently, issuance of pattadar pass books and title deeds to them.
Learned Assistant Government Pleader for Revenue, State of Telangana, would inform this Court, having received instructions, that the petitioners' representations are still pending consideration. It is not open to the Tahsildar, Choppadandi Mandal, Karimnagar District, to receive the representations of the petitioners and keep them pending indefinitely. The Tahsildar is bound to take a decision upon such representations and communicate his decision thereon expeditiously as the valuable property rights of the parties would be at stake.
SK, J WP.No.577 of 2019 Dt:18.02.2019 The Writ Petition is accordingly disposed of directing the Tahsildar, Choppadandi Mandal, Karimnagar District, to take appropriate action upon the petitioners' representations dated 17.3.2018, 20.8.2018 and 24.9.2018 in relation to the subject land expeditiously and in any event not later than four weeks from the date of receipt of a copy of this order.
