In this writ petition, petitioner challenges the notice, dated 01.12.2018, which was received by him on 26.12.2018, issued by respondent No.2 directing him to submit documentary evidence with respect to house bearing Nos.5-6-8 and 5-6-9 situated at Laskar Bazar, Hanamkonda.
The petitioner asserts that there are rival claims with respect to the property in question and thus, O.P.No.E/4347/2018 was filed by his father before the Revenue Divisional Officer and W.P.No.41993 of 2018 was filed by him before this Court and they are pending. He further asserts that on receipt of the impugned notice issued with regard to mutation of the subject property in favour of the third parties, the petitioner filed his objections on 29.12.2018 but no action has been taken pursuant thereto.
Learned Standing Counsel for respondent No.2 submits that there is no basis for the petitioner to apprehend that the objections said to have been filed by him would not be considered by the authorities having issued the impugned notice. He also submits that there is no acknowledgment with respect to receiving of objections, dated 29.12.2018, alleged to have been submitted by the petitioner.
Having regard to the respective submissions, the writ petition is disposed of with the direction to respondent No.2 to
consider the objections filed by the petitioner on 29.12.2018 pursuant to the impugned notice, before mutating the names with respect to the subject property.
