THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.172 OF 2024 O R D E R:

This Criminal Petition is filed under Section 438 of Code of Criminal Procedure (for short 'Cr.P.C.') by the petitioners/accused Nos.5 to 7 seeking bail in the event of their arrest in connection with Crime No.311 of 2023 on the file of Miryalaguda I Town Police Station, Nalgonda District, registered for the offences under Sections 307, 448 and 427 read with Section 34 of the Indian Penal Code.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the respondent-State. Perused the record.

According to the de-facto complainant, there was a fight in between the de-facto complainant and some others in the crackers shop, as a result of which the de-facto complainant received two simple injuries, one on the hip and the other on his finger.

Since the injuries received by the de-facto complainant are simple in nature and the fight is the result of the differences between the parties, this Court deems it appropriate to grant the relief of anticipatory bail, subject to following conditions:-

1) The petitioners/Accused Nos.5 to 7 are directed to surrender before the Station House Officer, Miryalaguda I Town Police Station, Nalgonda District, on or before 17.01.2024. Upon such surrender, the said Station House Officer shall release the petitioners/Accused Nos.5 to 7 on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to their satisfaction.

2) On such release, the petitioners/Accused Nos.5 to 7 shall appear before the concerned Police at 10:00 a.m. on every Monday for a period of eight weeks for the purpose of investigation and thereafter, as and when required.

3) The petitioners/Accused Nos.5 to 7 shall abide by the other conditions stipulated under Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed.

Miscellaneous applications, if any pending in this Criminal Petition, shall stand closed.
