Heard.

Alleging that the 5th respondent forged the documents and by influencing the Mandal Revenue Officer and revenue officials got his name and names of several others incorporated in the revenue records under the A.P. Rights in Land and Pattedar Pass Books Act 1971 (for short 'the Act, 1971'), without prior notice or opportunity to the petitioners, petitioners claim to have filed Appeal No.D/1075/2017 on 28.06.2017 before the Revenue Divisional Officer, Bhongir, Yadadri-Bhongir District. Along with the said appeal, an interlocutory application was also filed seeking stay of order of Tahsildar. Alleging that so far no orders are passed in the appeal as well as interlocutory application, this writ petition is filed.

It appears, from the material enclosed to the writ petition that appeal was preferred by the petitioners and it is already numbered. Therefore, the Court is not inclined to entertain the writ petition and keep the writ petition pending.

Since petitioners have already preferred appeal, the appellate authority i.e., Revenue Divisional Officer, Bhongir, is directed to consider the said appeal and/or interlocutory application by following due procedure after putting the 5th respondent on notice, take appropriate decision, as warranted by law, as expeditiously as possible, preferably within a period of four (4) months from the date of receipt of copy of this order.

With the above directions, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
