ORDER:

This writ petition is filed for a mandamus to declare the seizure of lorry bearing No.MH 25B 9670 along with 170 quintals of raw rice on 12.09.2009 by respondent No.1, as illegal and arbitrary. This Court, by order, dated 30.09.2009, granted interim direction to the respondents to release the seized lorry along with the rice to the petitioner on the latter furnishing a personal bond for Rs.2,00,000/- with one security to the satisfaction of respondent No.1. At the hearing, the learned counsel for either party is unable to state whether the proceedings under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act') have been completed and final order is passed or not.

In the above facts and circumstances of the case, respondent No.2 is directed to complete the proceedings under Section 6-A of the Act and pass final order, if he has not already done, within a period of two months from the date of receipt of a copy of this order. Subject to the above direction, the Writ Petition is disposed of. As a sequel to disposal of the writ petition, W.P.M.P.No.27465 of 2009 shall stand disposed of and W.V.M.P.No.3617 of 2009 shall stand disposed of as infructuous.
