HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO Crl.P.M.P.No.8304 of 2015 IN/AND CRIMINAL PETITION No.8289 of 2015 COMMON ORDER :
This criminal petition is filed by the petitioners/A.1 and A.2 under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.128 of 2015 of Jawaharnagar Police Station, Cyberabad, registered for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.
2. Pending the criminal petition, both parties filed Crl.M.P.No.8304 of 2015 along with the affidavit of the 1st respondent-de facto complainant stating that there was a memorandum of understanding regarding full settlement of the monitory claim and to take consent divorce and part of amount paid and remaining amount would be paid at the time of taking divorce, therefore, to accord permission to compound the above offence.
3. Having heard the parties, permission is thereby accorded as the parties stated that they have amicably settled the matter to purchase peace. Accordingly, the offences are compounded in terms of their compromise at the instance of the de facto complainant since present with the petitioners/A.1 and A.2.
4. Accordingly, Crl.P.M.P.No.8304 of 2015 is allowed.
Consequently, the criminal petition is allowed and all the proceedings relating to Crime No.128 of 2015 of Jawaharnagar Police Station, Cyberabad, are quashed against the petitioners/A.1 and A.2. The bail bonds of the petitioners/A.1 and A.2, if any, shall stand cancelled.
5. Miscellaneous petitions pending, if any, shall stand closed.
