HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.551 of 2019 ORDER:
The petitioner is aggrieved by the Memo dated 29.12.2018 issued by the Mandal Surveyor, Office of the Tahsildar, Medipally Mandal, Medchal-Malkajgiri District. By the said Memo, the Mandal Surveyor stated that as per the circular instructions, the request for demarcation of the land in Survey No.79/e of Peerzadiguda Village, Medipally Mandal, Medchal-Malkajgiri District, could not be undertaken.
The Memo does not disclose the actual reason for the refusal, but the learned Assistant Government Pleader for Revenue, State of Telangana, upon instructions, would inform this Court that there was no approved layout for the land in Survey No.79/e of Peerzadiguda Village in which the demarcation of plots was sought and therefore, the revenue authorities refused to undertake the survey.
The matter was adjourned on 21.01.2019 to enable Sri P.Shashi Kiran, learned counsel for the petitioner, to produce a copy of the proper approved layout.
Today, Sri S.Naresh, learned counsel representing Sri P.Shashi Kiran, learned counsel for the petitioner, would confess that he is not in a position to produce a copy of the approved layout but would state that in spite of the same, the revenue authorities are bound to undertake demarcation of the land.
This Court is at a loss to understand as to how the petitioner can seek demarcation of plots as per an unapproved layout. The participation of the revenue authorities in such demarcation cannot have the effect of validating an unapproved layout. The refusal by the revenue authorities to undertake such demarcation therefore cannot be held to be invalid.
The Writ Petition is accordingly dismissed.
Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
