This Second Appeal, under Section 100 of the Code of Civil Procedure, 1908, is filed by the appellant/ plaintiff, challenging the judgment, dated 24.04.2008, passed in A.S.No.57 of 2004 by the Principal Senior Civil Judge, Tenali, whereby, the judgment, dated 07.05.2004, passed in O.S.No.143 of 2002 by the Principal Junior Civil Judge, Repalle, was set aside.

During the course of hearing, it is brought to the notice of this Court by the learned counsel for the appellant/ plaintiff that the sole appellant/ plaintiff passed away.

Recording the said submission, this Second Appeal is dismissed as abated.
