HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.365 of 2020 ORDER:

The petitioner claims that his father was a protected tenant and is entitled to tenancy rights under AP (Telangana Area) Tenancy and Agricultural Lands Act, 1950. According to the petitioner, in the year 2018, the petitioner made an application to issue Section 38-E certificate. In response to the request made by the petitioner, RDO, Chevella Revenue Division directed Tahsildar, Moinabad Mandal to consider the request and take decision, but so far no decision is taken. On 01.02.2019, the petitioner made a representation to Tahsildar requesting him to process the application for issuance of Section 38-E certification. Alleging the inaction, this Writ Petition is filed.

A copy of the representation stated to have been made to the Tahsildar, Moinabad Mandal with endorsement of Tahsildar, is filed as Ex.P2 at page 14.

In view thereof, without expressing any opinion on merits, this Writ Petition is disposed of directing the Tahsildar, Moinabad Mandal to examine the claim of the petitioner as ventilated in the representation and take appropriate decision as warranted by law within a period of six weeks from the date of receipt of a copy of this order. No costs.
